Terms and conditions
The terms on which Australia Lucky Queena Pty Ltd supplies goods and services, read together with your rights under the Australian Consumer Law.
1. About these terms
These terms apply to your use of this website and to any goods or services supplied by Australia Lucky Queena Pty Ltd (ABN 93 703 526 989, ACN 703 526 989) (“we”, “us”, “our”). By using the website or accepting a quote from us, you agree to these terms. Where a written quote or supply agreement contains specific terms, those specific terms apply to that order alongside these.
2. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot lawfully be excluded.
3. Quotes and orders
Information on this website is a general description of what we do and is not an offer to supply. A quote from us sets out the goods or services, the quantity, the price and the expected timing, and remains open for the period stated in it. An order is formed only when you accept our quote in writing and we confirm it. We may decline an order, for example where goods are no longer available from the supplier, in which case any payment you have made for that order will be refunded.
4. Price and payment
Prices are in Australian dollars and are as stated in the quote. The quote will state whether GST is included and how and when payment is due. We will tell you about any change in price before an order is confirmed.
5. Delivery and risk
Delivery arrangements and estimated timeframes are set out in the quote. Timeframes are estimates; we will let you know promptly if a delay is expected. Risk in goods passes to you on delivery, and ownership passes once we have received payment in full.
6. Returns and faulty goods
If goods arrive faulty, damaged or not as described, email us at [email protected] with your order details and a description of the problem. We will deal with it in line with your rights under the ACL. Returns of goods that are not faulty are at our discretion unless agreed otherwise in the quote.
7. Limitation of liability
To the extent permitted by law, and subject always to the consumer guarantees in section 2, our liability for any loss arising from the supply of goods or services is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so; or, for services, supplying the services again or paying the cost of having them supplied again. To the extent permitted by law, we are not liable for indirect or consequential loss, such as loss of profit or business opportunity. This clause does not limit liability that cannot be limited under the ACL.
8. Intellectual property
The content of this website, including its text, design and graphics, is owned by or licensed to Australia Lucky Queena Pty Ltd. You may view and print it for your own use in dealing with us. You may not otherwise copy, reproduce or republish it without our written permission. Trade marks of third parties that appear in quotes or product descriptions remain the property of their owners.
9. Use of this website
We take reasonable care to keep the information on this website accurate, but it is provided for general information only and may change without notice. You must not use the website for any unlawful purpose or in a way that could damage or interfere with it.
10. Termination
Either party may cancel an order before it has been supplied by giving written notice, subject to any cancellation terms in the quote and to costs we have reasonably incurred at your request. We may suspend or end supply if you seriously breach these terms, including by failing to pay amounts due, after giving you written notice and a reasonable opportunity to fix the breach. Termination does not affect rights that have already arisen, or your rights under the ACL.
11. Governing law
These terms are governed by the law of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.
